ELIGIBILITY: The HEARTHnKETTLE.COM $25 Gift Certificate Contest ("Contest") is open to legal resident of the fifty (50) United States, the District of Columbia and Canada, eighteen (18) years of age or older on January 1, 2003 or if the age of majority is greater than eighteen (18) years in the jurisdiction where you live, you must be at least the age of majority on the date of entry. Contest IS SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. By entering the Contest, participants agree to abide by the terms and conditions of these Official Rules (the "$25 Gift Certificate Contest Official Rules"). The following persons are excluded from participation in this Contest: employees of HEARTHnKETTLE.COM, Inc. ("HEARTHnKETTLE.COM") and immediate family members of HEARTHnKETTLE.COM employees and its subsidiaries, affiliates, officers, directors, assigns, advertising, promotional and fulfillment agents, attorneys, accountants, and other representatives and the persons with whom each of the above are domiciled.

HOW TO ENTER: Online Entry: To enter, access the official entry form located at www.HEARTHnKETTLE.COM/Contest <https://thehearthandkettle.com/Contest> . You have the option to opt-in to the receipt of valuable offers from our marketing partners while entering the Contest. However, you need not do so to enter the Contest.

Contest PERIOD: The Contest begins 12:00:00 A.M. JULY 15, 2003 and ends at 11:59:00 P.M. ET on OCTOBER 15, 2003 ("Contest Period"). A winner will be drawn weekly and notified via email. The gift certificate will be mailed via USPO. All entries will be removed weekly upon selection of the winner. SPONSOR RESERVES THE RIGHT TO TERMINATE OR SUSPEND THE Contest WITHOUT NOTICE, AT ANY TIME AND FOR ANY REASON. SPONSOR ALSO RESERVES THE RIGHT TO ALTER OR AMEND THESE RULES AT ANY TIME PROVIDED.

CONDITIONS OF ENTRY: Each entrant in the Contest must be the rightful owner of, or have authorized use of, the email account indicated by the entrant's email address. In the event of a dispute regarding the identity of the person submitting an on-line entry, the entry will be deemed to be submitted by the person in whose name the email account is registered. No mechanically reproduced entries or facsimiles will be accepted. HEARTHnKETTLE.COM is not responsible for technical, hardware or software malfunctions, technical failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest or for any undelivered, deleted, lost, late, illegible, misdirected, incomplete, mutilated or postage-due entries. HEARTHnKETTLE.COM reserves the right to disqualify any individual who is responsible for or who tampers with the entry process, and to cancel, terminate, modify, or suspend the on-line portion of the Contest in the event it becomes infected by computer virus or is otherwise technically impaired. Entries become the property of HEARTHnKETTLE.COM and will not be returned.

Only one prize will be awarded per email address, individual, family, or household. Any federal, state or local taxes or duties due are the sole responsibility of the winner. Prizes will be mailed to the winner each week. Winners will be notified by email. Return of any prize notification or prize as undeliverable will result in disqualification and selection of an alternate winner.

ODDS OF WINNING: The odds of winning depend upon the number of eligible entries received.

WINNER SELECTION: Prize winner(s) will be determined on the basis of a random drawing. The drawing will be conducted weekly.  All winner selection procedures shall be conducted by Sponsor whose decisions are final with respect to all aspects of the Contest.

NOTIFICATION: Winner will be notified via email. The name of the Prize winners may be obtained on the HEARTHnKETTLE.COM web site. Limit one prize per household, per email address or per person per three hundred sixty five (365) day period. Prizes are nontransferable. No prize substitutions allowed.

GENERAL: By participating in this Contest, entrants agree to be bound by these $25 Contest Official Rules, including all eligibility requirements. By entering this Contest, you consent to Sponsor's use of your name and/or likeness for promotional purposes, including online announcements, without additional compensation, except where prohibited by law. By entering, entrants agree: (1) to be bound by these official rules; (2) that the decisions of HEARTHnKETTLE.COM are in all matters pertaining to the Contest; and (3) to release and hold harmless HEARTHnKETTLE.COM, its subsidiaries, representatives, sponsor, affiliates, directors, officers, employees and consultants from any and all liability, injuries, loss or damage of any kind arising from their participation or their acceptance and use of any prize. Any dispute arising from this Contest will be determined in accordance with the laws of the State of Massachusetts, without reference to Massachusetts' conflict of laws principles, and the entrants and winners hereby consent to the personal jurisdiction by the State and Federal Courts located in the County of Barnstable and do hereby waive specifically waive any personal jurisdiction defense that they may have to the exclusive jurisdiction of the State and Federal Courts located in the County of Barnstable over all such persons and such disputes relating to this Contest.

RELEASE: By registering for the Contest or accepting a prize, participants release HEARTHnKETTLE.COM, its subsidiaries, representatives, sponsor, affiliates, directors, officers, employees, advisors, attorneys and consultants from any and all liability claims or actions of any kind whatsoever and for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prizes, or while preparing for, participating in, and/or traveling to any prize-related activity. By registering for the Contest, participants agrees to the use of their name, address (city and state only) and/or photograph, videotape or any likeness for advertising or publicity purposes, and to the use of statements made by or attributed to participant relating to HEARTHnKETTLE.COM , and any and all rights to said use, without further compensation.

LIMITATIONS OF LIABILITY: HEARTHnKETTLE.COM is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with the Contest or by any technical or human error that may occur in the processing of entries in the Contest. HEARTHnKETTLE.COM assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries. HEARTHnKETTLE.COM is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, hacking, or any other causes beyond the control of HEARTHnKETTLE.COM which corrupt the administration, security, fairness, integrity or proper conduct of the HEARTHnKETTLE.COM Contest, HEARTHnKETTLE.COM reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. HEARTHnKETTLE.COM is not responsible for late, lost, illegible, incomplete, stolen, misdirected or postage due entries.
